Submitted Abstract

The workshop aims to identify, establish and present the underlying factors, challenges and opportunities linked to various forms and ways of interaction between judges across Europe. The workshop shall discuss and criticize the necessary preconditions for establishing the dialogue of judges. As the division between ‘public’ and ‘private’ law can suffer a lot of criticism, this workshop is the opportunity of gathering specialists from different legal backgrounds in order to establish a dialogue between fields of law, as well. The panels shall sketch the multiplicity of dimensions: vertical (preliminary ruling question, ECHR system); horizontal between domestic jurisdictions or between regional Courts and the variety of forms (formal, informal) of judicial dialogue. The invited speakers shall thus unravel the semantics of “judicial dialogue” from the point of view of the protection of fundamental rights and more specifically family law, the rights of the child, both in public and private law context.The workshop will be held in French and English.
